Insurance Commission Regulations for Bonding Agents

CORPORATE SURETY: A bonding company posts your bond for you to guarantee your attendance at court hearings. Bondsmen are subject to local rules for registration as outlined in the local rules below.

JUSTIFICATION OF SURETY: Property is put up for your bond. A Justification of Surety is obtained on your property from the County Clerk (2nd Floor, Room 205) and the lien encumbrance to date is noted, this reduces the amount of the proposed justification to post on your bond. The property used will now have a lien encumbrance filed against it to guarantee your attendance at court hearings. If you do not appear for court, the State may file a forfeiture proceeding and the property could be lost by you or your family member that posted their property for your bond.

PERSONAL RECOGNIZANCE (P/R): The Court believes you are a good risk to show up for all court appearances (usually holding a job and family located in County). Your signature is the requirement to post your bond.

CASH ONLY: Usually with a cash-only bond, the full amount of the bond must be posted with the Circuit Clerk for release from jail. The cash-only bond is usually imposed for a more severe type case of felony charges.

10 PERCENT CASH TO THE COURT

        * Home confinement (with or without GPS monitoring)
        * Partial bond and home confinement
        * Day report center
